The arbitration shall be conducted in English, and the venue shall be in South Africa. The arbitrator’s decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

11.4 Legal Fees

Each party shall bear its own costs and attorney’s fees incurred in connection with the arbitration, and the parties shall equally share the fees and expenses of the arbitrator, unless the arbitrator determines that a party’s claim or defense was frivolous or brought in bad faith, in which case the arbitrator may award attorney’s fees and costs to the prevailing party.

12. Miscellaneous Provisions

12.1 Entire Agreement
